WHEREAS S. 93 of the BNA Act provides protection for denominational schools in Canada based on the recognition of minority religious rights;

AND WHEREAS the protection of denominational schools is a matter which has serious ramifications for all Canadians since it relates to the protection of all minority religious rights in Canada;

AND WHEREAS the Province of Newfoundland has obtained and the Province of Quebec is now seeking exemption from the provisions of S. 93 of the BNA Act by way of a resolution of the Parliament of Canada only, without seeking approval by way of a valid constitutional amendment in accordance with the provisions of the Charter of Rights;

BE IT RESOLVED that constitutional protection for all minority religious rights in regard to education be continued under S. 93 of the BNA Act, and that any derogations of these rights be in accordance with the amending formula as set out in the Charter of Rights.
